Terms of Service

1. About these terms

These terms govern your purchase of food and related services from Booty Thai Kitchen ("we", "us", "our"), operated by BOOTY THAI KITCHEN LLC in Las Vegas, Nevada. By placing an order you agree to these terms. If you do not agree, please do not order.

2. Orders and cutoff

Orders for a given service day close at 2:00 PM that day. Placing an order is an offer to buy. Your order is accepted when we send you a confirmation email, and a contract is formed at that point and not before.

We may decline or cancel any order, including where we suspect fraud, where the delivery address falls outside our published zones, or where a dish sells out before your order is confirmed. If we cancel an order, we refund it in full.

3. Prices, tax and payment

Prices are shown in US dollars and exclude Nevada sales tax, delivery fees and tips, which are calculated and added at checkout. Payment is taken in full at checkout.

We may change prices at any time, but never after your order has been confirmed. If a price is listed in obvious error, we may cancel the affected order and refund you in full.

4. Food, allergens and preparation

Our food is prepared in a shared kitchen that handles peanuts, tree nuts, shellfish, fish sauce, soy, wheat, eggs and dairy. We cannot guarantee that any dish is free from any allergen, and we do not offer allergen-free preparation. If you have a food allergy or intolerance, you order at your own risk.

Dishes are cooked to a standard spice level and chili heat varies between batches. Our food is prepared fresh for same-day delivery. It is intended to be eaten on the day of service and is not sold for reheating or storage beyond that day. Once an order leaves our hands, safe handling and storage are your responsibility.

5. Delivery window

We deliver between 8:00 PM and 10:00 PM on your service day. We do not offer pickup.

Orders that cannot be handed over because nobody was available to receive them cannot be held, redelivered or refunded, because prepared food held outside temperature control is no longer safe to sell.

6. Delivery

Delivery is available within our published delivery zones and is subject to a minimum order value shown at checkout.

You are responsible for the accuracy of the address and phone number you provide, and for being available to receive your order. We may leave an order at the door at our discretion, and once it has been left, it is your responsibility. Delivery times are estimates and are not guaranteed.

7. Cancellations and refunds

Our Refund Policy forms part of these terms and governs all cancellations, refunds and problems with an order.

8. Communications

By placing an order you agree to receive transactional messages about that order by email, and by text message where you have provided a mobile number. Marketing emails and text messages are optional and require your consent. You can unsubscribe from marketing at any time using the link in any marketing message, or by emailing us.

9. Your conduct

Do not use this store to place fraudulent, abusive or resale orders, to impersonate another person, or to interfere with the operation or security of the site. We may refuse service to anyone at our discretion.

10. Intellectual property

The Booty Thai Kitchen name, logo, recipes, photography and site content belong to us and may not be copied or used commercially without our written permission.

11. Limitation of liability

To the fullest extent permitted by Nevada law, our total liability arising out of or relating to any order is limited to the amount you paid for that order. We are not liable for indirect, incidental or consequential losses. Nothing in these terms limits or excludes any liability that cannot lawfully be limited or excluded, including liability for death or personal injury caused by negligence.

12. Governing law and disputes

These terms are governed by the laws of the State of Nevada, without regard to its conflict of law rules. Any dispute arising out of or relating to these terms or your order will be brought exclusively in the state or federal courts located in Clark County, Nevada, and you consent to the jurisdiction of those courts.

13. Changes to these terms

We may update these terms from time to time. The version in effect at the time you place an order is the version that applies to that order.
